In connection with a draft decision submitted for consideration and adoption by the National Assembly on the termination of the current concession contracts for the extraction of gold, precious and rare metals No. 454-02-31, the Confederation of Employers and Industrialists in Bulgaria expresses its categorical non-support of the proposed answer.
Our motives for the expressed position are dictated by the fact that the parties to the concession contracts for the extraction of gold, precious and rare metals are on an equal footing, and the state, in its capacity as a grantor, should not unilaterally terminate the contract. Such behavior of the state will lead to a number of legal disputes between the grantor and the concessionaires of the terminated contracts, which will inevitably lead to obligations for the state to pay compensation for the damages caused by the premature and unilateral termination of the contracts. In the motives of the petitioners, there is no assessment of the amount of compensation that the state will have to pay when taking such actions. Given the investments and ongoing expenses in this proceeding, the compensation will be particularly large, which the ordinary taxpayer and business will have to pay.
With the termination of the concession contracts, the state will not only break the commitments it has made with authority, but will also send a bad signal and uncertainty to the rest of its business partners in the country.
