REGARDING: Bill for Amendment and Supplement to the Law on Civil Servants, No. 554-01-148, submitted by Petar Slavov and a group of people's representatives on 31.07.2015.
DEAR MR CALFIN,
In connection with Art. 76, Para. 3 of the Regulations for the Organization and Activities of the National Assembly on the occasion of the proposed amendment to the Civil Servant Law submitted to the National Assembly for discussion, the Confederation of Employers and Industrialists in Bulgaria, taking into account the views expressed by its members, expresses the following position:
KRIB supports the draft law, which aims to have the provision of Article 106, Paragraph 1, Item 6 of the Law on Civil Servants acquire a wording similar to the wording of Article 328, Paragraph 1, Item 10a of the Labor Code.
KRIB agrees that the amendment is necessary in connection with the harmonization of the legal framework for employees under employment law and for civil servants.
With the proposed change, the conditions for terminating an employment relationship under the Law on Civil Servants, with an employee who has exercised and acquired the right to a pension for insurance service and age, are achieved with the conditions for terminating an employment contract under the Labor Code with an employee who, by analogy manner exercised and acquired his right to a pension for length of service and age - art. 328, paragraph 1, item 10a of the Criminal Code.
